Trademark protection

Trademark protection: protect the name behind your business

You invest in your name, your reputation and the recognition of your business. Registering your trademark secures protection for your brand name or logo for the goods and services covered by the registration.

At Inaday, you choose the approach that suits you: get started online, arrange a comprehensive trademark search first, or speak directly with a trademark adviser.

How would you like to protect your trademark?

Get started online

For business owners who want to get started quickly and keep costs clear.

Our free trademark screening lets you check within minutes whether identical trademarks are found in the proposed classes of goods and services. You will also receive an initial automated indication of whether your brand name may be descriptive.

You can then easily request a trademark registration online. Benelux registration is available from €450 excluding VAT for one class.

The screening is a preliminary check. It does not include a comprehensive search for similar trademarks and does not guarantee that your trademark can be registered or used.

Start with a comprehensive search and advice

For business owners who want to understand the risks before investing in their brand.

A trademark with a different spelling but a similar sound or the same meaning can also present a problem. Our comprehensive trademark search therefore goes beyond identical names.

For €495 excluding VAT, we search for identical and similar trademarks and advise you on registrability, potential conflicts and the appropriate classes of goods and services.

This helps you make an informed decision before registering your trademark.

Prefer to speak with an adviser first?

For business owners who want to discuss their situation and have their registration taken care of.

Would you like to know which protection suits your business? Are you unsure whether to register your brand name or logo, or are you planning to operate in several countries? Discuss your plans with a trademark adviser.

You do not need to complete a lengthy form beforehand or work out which classes you need. We discuss your activities and recommend a suitable approach. Before you instruct us, we explain the work involved and the associated costs.

What does a trademark registration protect?

A trademark registration protects the name or sign that customers use to recognise your goods or services. This usually means:

  • A word mark: for example, your company name or product name.

  • A figurative mark: for example, your logo.

  • A combination of a name and a logo.

The appropriate registration depends on your trademark and how you use it. For example, registering a logo containing a name does not automatically provide the same protection as registering that name separately as a word mark.

The scope of protection also depends on the goods and services covered and the territory in which your trademark is registered. It is therefore important to consider not just your name, but also your current activities and future plans.

Why register your trademark?

Registering with the Chamber of Commerce or owning a domain name is not the same as registering a trademark. A registered trademark gives you a clearly defined right that, subject to certain conditions, allows you to take action against the use of identical or confusingly similar trademarks.

A trademark registration helps you:

  • Protect your business name and identity.

  • Take action against trademark infringement.

  • Build the value of your brand.

  • Authorise others to use your trademark, for example through a licence.

A well-chosen registration reflects both what your business does today and where you want it to go.

Can any name be registered as a trademark?

Not every name is suitable as a trademark. Among other requirements, a trademark must be sufficiently distinctive and must not merely describe the goods or services you offer.

Earlier trademarks may also present a risk. This is not limited to exactly the same name: similarities in spelling, sound or meaning can also be relevant.

Our free screening provides an initial indication. Would you also like an assessment of the risks posed by similar trademarks and advice on your protection? Choose our comprehensive trademark search and advice.

Where would you like to protect your trademark?

Benelux

A Benelux registration protects your trademark in the Netherlands, Belgium and Luxembourg. This is often a suitable option for businesses operating mainly in these countries.

European Union

An EU trademark application seeks protection in all European Union countries. This may suit businesses operating in several EU countries or with concrete plans to expand into those markets.

Outside the European Union

We can also arrange trademark protection outside the EU. The appropriate route depends on the countries in which you operate or plan to operate.

You do not need to make this decision on your own beforehand. We help you align the geographical scope of protection with your activities, plans and budget.

How much does trademark registration cost?

The costs mainly depend on the geographical scope of protection, the number of classes of goods and services, and the search and advice you require.

  • Benelux registration: from €450 excluding VAT for one class.

  • EU registration: from €1,225 excluding VAT for one class.

  • Comprehensive trademark search and advice: €495 excluding VAT.

Looking after your trademark beyond registration

A trademark registration is generally valid for ten years and can be renewed repeatedly. We monitor your renewal deadline and notify you in good time.

Trademark monitoring can also help identify new applications for potentially conflicting trademarks. When you register through Inaday, your first year of trademark monitoring is free. You can then continue the service through a subscription.
